Working Women Wednesday: Celebrating Women in the Trucking Industry

As you may know, March is Women’s History Month. Here at ExpressTruckTax we want to celebrate and highlight the accomplishments of women in the trucking industry. The trucking industry has been thought to be a mostly male-dominated industry, but in recent years more and more women have started trucking, some even going as far as starting their own trucking companies. 

Each week in March we will feature different women-owned trucking companies and this week we are focusing on Serita Lockley.

Serita Lockley is the owner of Lady Lockley’s Trucking LLC as well as Like Minded Links LLC, a consulting company dedicated to guiding people through the process of getting into the trucking industry and helping them succeed. According to the introduction on her website, Lockley states she is “a no-nonsense, positive professional whose first priority is always the interests of my clients; providing capability, adaptability, and scalability through consultation and mentorship.” Lockley also has started 3 other successful businesses.

Lockley has had her own trucking business, Lady Lockley’s Trucking LLC, for over 10 years. She appeared in the Amazon Prime Video docuseries “Regular Heroes”, Trucknhustle podcast episode 74, and was also featured in Out Front Magazine. 

Currently, Lockley is active on Instagram @ladylockleystrucking within the trucking industry and actively seeks to help people get their start in the trucking industry. She is one of the many women helping to pave the way for women in the trucking industry.

First Used Month: What Is It And How Does It Relate To Your Form 2290?

Filing Form 2290 is done when your vehicle weighs over 55,000 pounds. If your vehicle travels less than 5,000 miles a year or 7,500 miles if it is used for agricultural purposes, you still have to file Form 2290 but you don’t have to pay the tax because your vehicle is then considered suspended/exempt. No matter if your vehicle is suspended/exempt or not when you file your Form 2290 you have to enter your first used month. 

What is a First Used Month?

The words “first used month” will appear several times in ExpressTruckTax and when you are filing your Form 2290. What does it mean? The first used month refers to the first month that you put your truck on the road during the specific tax year and does not have to do with the date on your tags. The Form 2290 tax year is July 1 to June 30.  If a truck has been put on the road for the first time in the middle of a tax year then the month you put the truck on the road will be your first used month. If your truck has been on the road for longer, however, your first used month will be July. Your first used month along with the weight of your vehicle is what determines how much your Heavy Vehicle Use Tax (HVUT) will be once you file your Form 2290.

Filing Your 2290: Which Business Type is Right for You?


Tax season is fast approaching and so is the deadline to file your Form 2290. These forms often ask questions that might seem confusing at first. One of the questions you’re asked when you sign up to file is which business type you are filing under? What is a business type and how do you know which one is right for your trucking business? 

Below, you will find a helpful guide explaining more about each type to determine which is the best fit for you.

Sole Proprietor or Single Member LLC

To sum it up, a sole proprietor is the single owner of a business.

S-Corporation of LLC as S-Corp

S-Corporations are corporations that elect to pass corporate income, losses, deductions, and credits through their shareholders for federal tax purposes. This allows S-corporations to avoid double taxation on the corporate income.

C-Corporation or LLC as C-Corp

C-Corporation, Under United States federal income tax law, is any corporation that is taxed separately from its owners. Unlike C-Corporations, S-Corporations are not taxed separately.

Partnership or LLC as Partnership

A partnership is where two or more people own the business.

Estates

Estates are all of the money and property owned by a particular person, especially at death.

Trusts and Fiduciaries

A trust is a relationship when one person holds the title to the property. A fiduciary is a person or organization that acts on behalf of another person. 

Exempt Organization

In order for an organization to be considered exempt, it must be a charitable organization, private foundation, or other similar organization that is exempt from federal income tax.

What Happens if You Choose the Wrong Business Type?

Don’t worry it happens, we all make mistakes. You can simply click your name in the upper-righthand corner and then click the drop-down arrow. You will then click on “My Account” which will lead you to a page with multiple options. From there select the option titled “Manage Businesses” by clicking on the pencil icon. 

When you see the name of the business you want to change, click on the pencil icon to the right of it and it will take you to the page that will allow you to change the business type. 

Then under business type select the dropdown and from there you can select the business type that best describes your trucking business.

Does Your Trucking Business Need to File 1099-NEC and W-2?

Running your trucking business is no easy task, there are so many different demands and requirements. This includes filing and distributing Forms W-2 and 1099-NEC each year.

If you employ truck drivers or hire them as independent contractors, you are required to file Forms W-2 with the Social Security Administration (SSA) and/or 1099-NEC Form with the IRS.

When are the Form W-2 and 1099-NEC Deadlines?

The IRS and SSA require that employers file Forms 1099-NEC and W-2 and distribute copies to their employees and independent contractors. The deadline to do this is January 31, 2022. 

What is Form W-2? 

The Form W-2 is a wage tax form that reports the wages you paid to your employees and the taxes that you withheld from their pay. This includes social security, Medicare, and income taxes. 

Your employees need a copy of their Form W-2 in order to complete their own personal taxes and properly report their income to the IRS. 

What is Form 1099-NEC?

Businesses should report all non-employee compensation using Form 1099-NEC for the 2021 tax year. The deadline to file and distribute Form 1099-NEC is also January 31, 2022. 

If your drivers are independent contractors rather than full-time employees on your payroll, you will need to complete Form 1099-NEC instead of a W-2 Form, if you paid them $600 or more 

It is still very important that you provide your independent contractors with a copy of their Form 1099-NEC, as they will need this information to report their income when filing their taxes.

All You Need To Know About The 4th Quarter IFTA Deadline

January 31st is coming at you faster than you realize. If you are over the age of 31, you know what I mean. You blink, and it’s Christmas, New Year’s, then Easter again and again and again!

Your fourth quarter IFTA report is due Monday, January 31st. Here’s a quick rundown of what you need and how we can make your life easier. 

What Is IFTA?

Most of you know this information. But for those in the back, IFTA is an agreement between the lower 48 states and the ten Canadian provinces that requires all interstate motor carriers with the following qualifications to obtain an IFTA tax license and file quarterly IFTA reports: 

  • Your vehicle has a GVW above 26,000 lbs
  • Your vehicle has 3 or more axles regardless of weight
  • Your vehicle crosses state lines

IFTA Deadlines

Once you have an IFTA tax license, you must file quarterly IFTA reports. The quarterly IFTA report filing dates are listed below. These dates are vital for you to remember so that you never fall behind and owe late filing penalties. 

  • 1st Quarter Deadline – April 30th 
  • 2nd Quarter Deadline – July 31st 
  • 3rd Quarter Deadline – October 31st
  • 4th Quarter Deadline- January 31st

To file your 4th quarter IFTA report, you must provide the total mileage driven and total gallons of fuel purchased in each state for your entire fleet from October 1st, 2021 to December 31st, 2021. You must file a quarterly IFTA report, even if you have had a zero mileage quarter!
