EIN Necessary To File Form 2290

The IRS requires ANY taxpayer filing a Form 2290 to use an EIN or Employer Identification Number when filing. The IRS expressly prohibits the use of social security numbers for the filing of 2290.

To get an  Employer Identification Number from the IRS, you can follow one of the following options:

  • a. Apply Online: The customer can obtain an EIN immediately by visiting IRS Online EIN application
  • b. Apply over the phone: Taxpayers can obtain an EIN immediately by calling the Business & Specialty Tax Line at (800) 829-4933. The hours of operation are 7:00 a.m. – 10:00 p.m. local time, Monday through Friday. An assistor takes the information, assigns the EIN, and provides the number to an authorized individual over the telephone. Note: International applicants must call (215) 516-6999 (Not a toll-free number).
  • c. Apply Fax: Fax the completed form SS-4 to IRS. If you provide a return fax number, IRS will send a fax to that number within 4 days with a new EIN.
  • d. Apply through Paid Provider: You can use a CPA or a process agent, like ExpressTruckTax Plus and let them take care of preparing and filing the return for you.
  • e. Apply by Mail: This is the slowest way to get the EIN number. mail the completed Form SS-4 to the IRS. The address is listed on the form itself. This could take up to 4 weeks to get the EIN number.

RecordKeeping Requirements For Form 2290

There are specific recordkeeping requirements regarding Form 2290.  According to the Instructions for the IRS Form 2290:
You must keep records for all taxable highway vehicles registered in your name for at least 3 years after the date the tax is due or paid, whichever is later. They must be available at all times for inspection by the IRS. Also keep copies of all returns and schedules you have filed. Keep your records even if a vehicle is registered in your name for only a portion of a period. If the tax is suspended on a highway motor vehicle for a period because its use on public highways during the period did not exceed 5,000 miles (7,500 miles for agricultural vehicles), the registrant must keep the records at least 3 years after the end of the period to which the suspension applies.

Records for each vehicle should show all of the following information. 

  • A detailed description of the vehicle, including the VIN 
  • The weight of loads carried by the vehicle in the same form as required by any state in which the vehicle is registered or required to be registered. 
  • The date you acquired the vehicle and the name and address of the person from whom you acquired it. 
  • The first month of each period in which a taxable use occurred and any prior month in which the vehicle was used in the period while registered in your name, with proof that the prior use was not a taxable use. 
  • The date the vehicle was sold or transferred and the name and address of the purchaser or transferee. If it was not sold, the records must show how and when you disposed of it. 
  • If the tax is suspended for a vehicle, keep a record of actual highway mileage. For an agricultural vehicle, keep accurate records of the number of miles it is driven on a farm.

E-File the Form 2290 For any Heavy Vehicles First Used in April 2012

HVUT, or the Heavy Vehicle Use Tax Although the Heavy Vehicle Use Tax is imposed annually, it is also mandatory for vehicles to file for this using the IRS form 2290 after the first use month. The typical tax year for heavy vehicles begins on July 1 and ends on June 30. For vehicles that are first used during the tax year, a prorated tax must be paid for the months that the vehicle was in use. When a new vehicle is placed in service, the Form 2290 must be filed by the last day of the following month. For Example, vehicles that were placed in service during the month of March will need to file HVUT using the 2290 by April 30. The tax will be calculated based on the number of months the vehicle will have been used during the tax year. Remember that the tax year for Heavy Highway Vehicles is from July to June. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For Example, if a vehicle was used on March 28th, It will be taxed as though it was used the entire month.
Although it is rare, some Vehicles that fit the above description may be exempt from the HVUT and Filing requirements of Form 2290. To officially be exempt from filing Form 2290, the vehicle must be owned and operated by the following:

• Non-Profit Volunteer Fire Department, Ambulance Association, or Rescue Squad
• Indian Tribe Government (Only if the Vehicle is Used for essential Tribe or Government Function)
• American National Red Cross
• Mobile Machinery that meets specifications for a chassis
• Qualified Blood Collector Vehicles

Each Year, Heavy Vehicle owners must file an IRS Form 2290 in order to fulfill the Heavy Vehicle Use Tax. This applies to all vehicles whose taxable gross weight is 55,000 pounds or more.
