Do You Need To File Form 2290?

If you’re new to trucking, the numbers used for necessary forms may be a bit overwhelming. There’s the 2290s, 8849s, 4868s, 1099s, and 123s. Okay.. we might be exaggerating with the 123s, but you get the gist, it’s a lot of forms and a lot of numbers to remember. We won’t bore you and got through each form 1 by 1, but we will tell you about the two most relevant ones for this filing period.

What is Form 2290?

The form that you have probably heard the most about, as of late, is Form 2290. What is Form 2290, and how does it relate to you, if at all?!

Form 2290 is used to figure and pay the tax due on highway motor vehicles used. Your next question is probably does it even apply to you, and the answer is it might. All vehicles with a taxable gross weight of 55,000 pounds or more than travel by highway is required to file a Form 2290.

After paying taxes you will be given a Stamped Schedule 1 that serves as proof of payment from the IRS. This document is important, as it is needed in order to register your commercial vehicle.

Do You Need to File Form 8849?

There are exemptions and claim suspensions that apply to some vehicles meeting certain requirements. The requirements are as follows:

  • The vehicle used 5,000 highway miles or less during the period.
  • The vehicle is an agricultural vehicle and used 7,500 miles or less during the period.
  • The Vehicle was stolen during the period
  • The vehicle was destroyed during the period
  • The vehicle was sold during the period

The above list leads us to the importance of Form 8849. If any of the above is true about a vehicle you own/owned then you must first file a Form 2290, pay the correct amount of Heavy Vehicle Use Tax (HVUT) and then complete the Form 8849.

Claims and Refunds

In order to claim credits or refunds for vehicles stolen, destroyed, sold, or only used for 5,000 miles or less and 7,500 miles or less for agricultural vehicles, the Form 8849 is required. The

things you’ll need to file a Form 8849 are your name, address, details on the vehicle you are seeking a claim/refund for and your Employee Identification Number (EIN). Be sure to double check that the EIN you are using is consistent with what the IRS has on file.

*If an EIN is needed you are able to apply for one online with the IRS.

If your form is rejected, then it’s up to you to correct it and retransmit it to the IRS in time; otherwise, you will still face late filing penalties.

Why 2290 Forms Are Commonly Rejected

EIN Problems

You need an EIN or Employer Identification Number to complete your IRS Form 2290. There’s no way around it. If you use your SSN (Social Security Number) in place of your EIN when you file Form 2290, it will be rejected instantly.

Duplicated IRS Form 2290

Your rig’s VIN (Vehicle Identification Number) can only be filed for once during the HVUT tax period. Duplicates will be rejected, so make sure that you’re filing for the current tax period which runs from July 1st, 2018 to June 30th, 2019. If you accidentally filed for the previous tax period then that could be why your form is considered a duplicate.

You also need to make sure that you enter your VIN correctly. If it’s one character off, then your form could get rejected. If your form is rejected for this reason don’t panic, you can quickly and easily file free VIN corrections with ExpressTruckTax.

RTN Errors

You can pay the amount of HVUT you owe to the IRS through direct debit or electronic funds withdrawal, and that process involves providing your bank account number and RTN (Routing Transfer Number).

If you enter this information with as little as one character off, the IRS will not be able to debit the funds, and your form will be rejected. This is also the case if you do not have enough funds in your account to cover the full amount.

All About Your HVUT Form 2290

So what exactly is the HVUT Form 2290? It is the tax assessed on the use of public highways by heavy vehicles with gross weights of 55,000 pounds or more. The truck tax collected is used to repair, maintain, and build public highways.

If a taxable highway motor vehicle is registered in your name in the United States, the District of Columbia, Canada, or Mexico you must file an HVUT Form 2290.

A taxable highway motor vehicle is any vehicle with a gross weight of 55,000 pounds or more and includes any self-propelled vehicle designed to carry loads over public highways, regardless if it’s designed to perform other functions. A taxable vehicle consists of a chassis or a chassis and a body but does not include the load.

The current HVUT tax period began on July 1, 2018, and will end on June 30, 2019. The HVUT is based on your first use month and is due by the last day of the month following the first use month.

For example, if you first use your truck in October, then your Form 2290 will be due by November 30th. However, if your current vehicle was in use during the previous tax year, you are required to file by the August 31st deadline.

Attention Truckers! Your IRS Form 2290 is Due FridayOnce you file Form 2290, you will receive a copy of your stamped Schedule 1 which serves as your proof of payment for your truck tax. Before we get into pre-filing or filing your IRS Form 2290, let’s go over a critical piece of information you will need to have. As an owner-operator, you are required to have an employer identification number, or more commonly known as an EIN. It is used by the IRS to identify your trucking business. EINs are assigned to companies operating in the United States to identify them for tax reporting purposes.

What is an EIN Number?

Your trucking business’s EIN will be a string of nine digits, similar to your Social Security Number, but they can be easily distinguished because of their format (EIN: 12-3456789 SSN:123-456-789). For IRS Form 2290 Is my Rig an Agricultural Vehicle?One question we often run into is “What is an agricultural vehicle for IRS Form 2290?” That is because when you file IRS Form 2290, you are asked to indicate whether your taxable vehicle is used for agricultural purposes.

Depending on your vehicle type and how you use it, the tax rates and filing requirements vary. This is just one reason why it’s so important to categorize your taxable vehicle correctly when filing your HVUT Form 2290.

We recently discussed the different requirements for logging vehicles, which are vehicles used solely for the transport of forested materials. Logging vehicles are taxed at a lower rate than typical heavy vehicles, so if you drive a logging truck, be sure to check “used for logging” to be taxed at the lower rate!

Another type of taxable vehicle with special requirements is the agricultural vehicle.

Agricultural Vehicles & Higher Mileage Limits

Vehicles typically required to file HVUT are those with a taxable gross weight over 55,000 lbs and that travel over 5,000 miles on public highways throughout the tax period.

BUT to give farmers a break, the IRS made the requirements a bit more lenient for vehicles used in agriculture. Agricultural vehicles, regardless of their weight, are allowed to drive up to 7,500 miles on public highways each year before having to pay any tax at all!

Just to clarify, this does not mean that you don’t have to file HVUT at all. If your gross vehicle weight is over 55,000 pounds, you must still file HVUT and receive a stamped Schedule 1. However, if your agricultural vehicle will drive fewer than 7,500 miles throughout the tax year, you will owe zero tax when you file! This is known as filing a Category W or a Suspended/Low Mileage Vehicle. 

Does My Vehicle Qualify as an Agricultural Vehicle?

To ensure that your vehicle qualifies as an “agricultural” vehicle according to IRS standards, here are the two requirements your vehicle must meet:

  • 1. The vehicle is used primarily for farming purposes throughout the tax year. But what does the IRS consider “primarily for farming purposes”? It’s actually quite simple. More than half of the vehicle’s total mileage for the year must be used for farming purposes. 
  • And a farming purpose, according to the IRS, is any activity that contributes to the conduct of a farm. This can include activities such as transporting goods to and from a farm (goods like livestock, produce, animal feed, fertilizer, etc), direct use in agricultural production, or just performing work around the farm like repairing fences, building irrigation ditches, clearing land, etc. 

-AND-

  • 2. The vehicle is registered as an agricultural vehicle in your state. Although your vehicle must be registered as such, no special license plates or tags marked “agriculture” are required to maintain your status as an agricultural vehicle.
  • If your vehicle meets both of these requirements above, then you can file as an agricultural vehicle with a higher mileage limit!!

To file as a suspended agriculture vehicle, skip the first “Taxable Vehicle” section of 2290, and instead enter your vehicle’s information under the “Low Mileage/Suspended Vehicle” section. And be sure you check the box “Used for Agriculture.” 

Exceeding the Mileage Limit

Occasionally, agriculture vehicles will be filed as Suspended (Category W) at the beginning of the tax period, but then exceed the 7,500-mile limit during the year.

If your vehicle goes over, you must file a Form 2290 Amendment for a Mileage Increase. The amendment is due by the end of the month following the month in which you exceeded the limit. This means that if you went over 7,500 in January, then the amendment must be filed by the last day of February.

When filing the mileage increase amendment, the IRS will prorate your HVUT for the remaining months of the tax year (which runs from July 1st to June 30th each year). This means that even though you will owe some tax, it will not be the full amount you would’ve owed if you had filed as a non-suspended vehicle initially. Hooray, for lower tax!

Happy fall! We hope you have been enjoying the cooler temperatures and maybe you’ve had the chance to catch a football game or two. Fall is a great time to relax before the holiday rush begins. You can really take a load off by knowing that you’re already handled you Heavy Vehicle Use Tax (HVUT) back in August around the 31st when From 2290 was due.

My HVUT Is Late, What Do I Do? 

You are probably wondering if there are any penalties for filing late so we will get those out of the way first. The penalty for filing HVUT Form 2290 late is equal to 4.5% of the total tax due assessed on a monthly basis for up to five months. If you also make a late HVUT payment you will also face a monthly penalty of .5% of the total tax due and additional interest charges of .54% will accrue per month as well.

Those are some hefty fees, so it’s best to go ahead and file as soon as possible to avoid having them grow larger. However, if you can provide reasonable cause for filing late you may not face penalties. Simply attach your reasonable cause with your Form 2290 when you file and the IRS may accept or reject it.

The HVUT period started in July 2017 and will end in June 2018. The due date is based on your first used month for your heavy vehicles. You have until the last day of the month following the month you first use your heavy vehicle on public highways to file.

So, because most truckers first used their trucks in July at the beginning of the period, they have until August 31st to file, making it a major HVUT deadline day. However, if first use your truck later in the year, then you have a later deadline. For example, if you first use your truck in November then you have until December 31 to file.
