E-File Form 2290 for Vehicles First Used in March

When a new vehicle is placed in service, the Form 2290 must be filed by the last day of the following month. If you first placed your vehicle on the road anytime in March, you can file your Form 2290 anytime between now and April 30, 2013. If a vehicle was used during any part of a month, the tax will be calculated for that month as a whole. For example, if a vehicle was used on March 25th, it will be taxed as though it was used the entire month.

The Heavy Vehicle Tax Year runs from July 1 through June 30 of the following year. When a vehicle is first placed on the road at any time during the tax year, the tax will be prorated based on the number of months the vehicle will have been used during the tax year. So vehicles that were placed in service during the month of March will need to file HVUT using the Form 2290 by April 30, and the tax will be based on 4 months, instead of the full year. For vehicles first used in April, the tax will be based on 3 months and so on.

While the deadline is the last day of the following month, you may need to file your Form 2290 before the deadline in order to get or renew your IRP plates.  Many states require proof that your 2290 was filed before they will issue or renew your plates.

Transferred Truck During Tax Year

A common question our Support Team at ExpressTruckTax gets is how to handle the situation when a vehicle is transferred to another company during the tax year.  Assuming the Form 2290 was filed and the tax was paid for the current year, you would need to file a new Form 2290 under the new business name and EIN.  On the return, you will be able to claim the refund for the taxes that were paid under the previous business name and EIN.  You will need to call the IRS directly and they will walk you through the process or you can have a service provider, like ExpressTruckTax Plus to do it for you.

NOTE: The Form 2290 must be filed no later than the end of the month following when the transfer took place.  Example, if you formed a new business and the vehicles began operating under the new business name in February, your Form 2290 would have to be filed no later than March 31st.  If you file after March 31st, the return will be considered late and you may incur penalty fees.

Although the HVUT, or the Heavy Vehicle Use Tax is imposed annually, it is also mandatory for vehicles to file the IRS Form 2290 after the first use month. The typical tax year for heavy vehicles begins on July 1 and ends on June 30. For vehicles that are first used anytime during the tax year, a prorated tax must be paid for the months that the vehicle was in use. An EIN is an Employer Identification Number, also known as a Federal Tax Identification Number, and can be used to verify a business entity.

NOTE: Remember, for vehicles first used in November, the due date to file your Form 2290 is December 31, 2012. While you can get your EIN immediately, it can take the IRS up to 10 business days to update new EINs into their system; so you will want to get your EIN today!

Understanding Your HVUT Responsibilities

What is HUVT?
HVUT is the Heavy Vehicle Use Tax that is a fee assessed annually on heavy vehicles operating on public highways at registered gross weights equal to or exceeding 55,000 pounds. The gross taxable weight of a vehicle is determined by adding the unloaded weight of the motor vehicle and any trailers together with the maximum load customarily carried on-road by the truck-trailer combination.

Who Must File?
You must file Form 2290 for the tax period beginning on July 1, 2013, and ending on June 30, 2014, if a taxable highway motor vehicle is registered, or required to be registered, in your name under state, District of Columbia, Canadian, or Mexican law at the time of its first use during the period and the vehicle has a taxable gross weight of 55,000 pounds or more.  The deadline to file is August 31, 2013.

What is Required?
You need the details of your business – Business Name (Sole proprietor can use their legal name) and address, EIN (Employer Identification Number) , details of the authorized signatory.

You need the details of your vehicle – Vehicle Identification Number (VIN) and Gross weight of the Vehicle
If you are going to pay the IRS by direct debit (we strongly recommend it), keep the routing number and the account number ready.

When to File?
Heavy Vehicle Use Taxes must be filed using the Form 2290 on an annual basis. The Tax period for Heavy Vehicles begins on July 1st and ends on June 30th of the following year. The annual renewal of your Form 2290 for a new tax period IS DUE BY August 31st each year.

For new vehicles placed in service, the IRS Form 2290 must be filed by the last day of the month following the month of first use. For example, if you purchase and first use a vehicle in October, you must file a Form 2290 by the end of November.

How to File?
Electronically.  File Form 2290 electronically through any electronic return originator (ERO), transmitter, and/or intermediate service provider (ISP) participating in the IRS e-file program for excise taxes, such as ExpressTruckTax.com. E-Filing is required by the IRS, if you are reporting 25 or more trucks on a return.
