IRS Form 2290 Deadline

If you own or drive a Heavy Highway Vehicle, you are probably curious about the new tax period for Heavy Vehicle Use Taxes. The New Tax Year for Heavy Vehicles will begin on July 1, 2013 and end on June 30, 2014.

The Filing Season for this new Tax year begins on July 1, and the due date is typically the end of August, but since August 31st is a Saturday and Monday Is Labor Day, the final due date for Form 2290 is Tuesday, September 3, 2013.

If you put a new vehicle in use during the Tax period, then the due date will be the last day of the following month. For example, if a new vehicle is placed in service in August, the due date for the 2290 would be September 30th.

RecordKeeping Requirements For Form 2290

There are specific recordkeeping requirements regarding Form 2290.  According to the Instructions for the IRS Form 2290:
You must keep records for all taxable highway vehicles registered in your name for at least 3 years after the date the tax is due or paid, whichever is later. They must be available at all times for inspection by the IRS. Also keep copies of all returns and schedules you have filed. Keep your records even if a vehicle is registered in your name for only a portion of a period. If the tax is suspended on a highway motor vehicle for a period because its use on public highways during the period did not exceed 5,000 miles (7,500 miles for agricultural vehicles), the registrant must keep the records at least 3 years after the end of the period to which the suspension applies.

Records for each vehicle should show all of the following information. 

  • A detailed description of the vehicle, including the VIN 
  • The weight of loads carried by the vehicle in the same form as required by any state in which the vehicle is registered or required to be registered. 
  • The date you acquired the vehicle and the name and address of the person from whom you acquired it. 
  • The first month of each period in which a taxable use occurred and any prior month in which the vehicle was used in the period while registered in your name, with proof that the prior use was not a taxable use. 
  • The date the vehicle was sold or transferred and the name and address of the purchaser or transferee. If it was not sold, the records must show how and when you disposed of it. 
  • If the tax is suspended for a vehicle, keep a record of actual highway mileage. For an agricultural vehicle, keep accurate records of the number of miles it is driven on a farm.

Form 2290 First Use Month

When E-Filing Form 2290 with ExpressTruckTax, you will be asked to provide the first use date for the vehicle. This dates refers to the time when the vehicle was placed in service during the tax period.  If the vehicle has been placed in service for  previous years and will continue to be in service this year, the first use month will be July.  This is because the tax period for Heavy Vehicle Use Taxes begins in July and ends in June.

If a new vehicle is placed in service during the tax period, the first use month will be the month in which the vehicle was first used. If a vehicle was only used for part of the tax period, the tax will be prorated based on the number of months the vehicle was actually used. For example, if a vehicle was used on May 27th, it will be taxed as though it was used the entire month, regardless of the fact it was only used for a couple of days, and the tax will be based on 2 months, instead of the full year.

Can I File IRS Form 2290 Without an EIN?

Unfortunately, the answer is no. The IRS requires ANY taxpayer filing a Form 2290 to use an EIN or Employer Identification Number when filing. The IRS expressly prohibits the use of social security numbers for the filing of 2290.

We receive many questions from taxpayers who believe they’re not a business – simply a driver. In these cases, you still need to have a business such as a sole proprietorship.

To get an  Employer Identification Number from the IRS, you can follow one of the following options:

  • Apply Online: The customer can obtain an EIN immediately by visiting IRS Online EIN application
  • Apply over the phone: Taxpayers can obtain an EIN immediately by calling the Business & Specialty Tax Line at (800) 829-4933. The hours of operation are 7:00 a.m. – 10:00 p.m. local time, Monday through Friday. An assistor takes the information, assigns the EIN, and provides the number to an authorized individual over the telephone. Note: International applicants must call (215) 516-6999 (Not a toll-free number).
  • Apply Fax: Fax the completed form SS-4 to IRS. If you provide a return fax number, IRS will send a fax to that number within 4 days with a new EIN.
  • Apply through Paid Provider: You can use a CPA or a process agent, like ExpressTruckTax Plus and let them take care of preparing and filing the return for you.
  • Apply by Mail: This is the slowest way to get the EIN number. mail the completed Form SS-4 to the IRS. The address is listed on the form itself. This could take up to 4 weeks to get the EIN number.

NOTE: Remember, for vehicles first used in June, the due date to file your Form 2290 is July 31, 2013. While you can get your EIN immediately, it can take the IRS up to 10 business days to update new EINs into their system. You cannot E-File your Form 2290 until your EIN is is the system, so you will want to get your EIN today to ensure you can file by the deadline!

June 30th Deadline for Heavy Vehicles First Used in May 2013

As stated in the Form 2290 instructions found on irs.gov, the Form 2290 must be filed by the last day of the month following the month of first use. June 30th  marks the Form 2290 filing deadline for any heavy vehicles that were first used in May 2013.

Any vehicles used less than 5,000 miles (7,500 miles agricultural) during the tax period will have no tax due to the IRS, but are still required to file their Form 2290 return to avoid any penalty.

New 2013-2014 Form 2290 Tax Year Is One Week Away

The new Heavy Vehicle Use Tax (HVUT) year begins July 1, 2013 and runs through June 30, 2014.  The Form 2290 filing deadline for all taxable vehicles for the new tax year is August 31, 2013.  All tax must be paid in full by the deadline to avoid penalties.

The tax is based on the gross vehicle weight and ranges from $100 to $550 per year per vehicle.  For vehicles first used during any other month than July during the tax period, the tax is prorated and due by the last day of the month following the month first used.  For example, if a vehicle will be first used in December, the Form 2290 would have to be filed by January 31, 2013.  There is no tax due for any vehicle used than 5,000 (7,500 agricultural) miles during a tax period.  The Form 2290 return would still need to be filed, but the vehicle would be classified as a suspended vehicle, so no tax would be due.  There are other circumstances where a vehicle is classified as suspended, but ExpressTruckTax enables you to identify those vehicles.

EIN Is REQUIRED to File Form 2290

If you are filing Form 2290 for Heavy Vehicle Use Tax (HVUT), you must have an EIN to file the return. The IRS does not accept Social Security Numbers for the Form 2290. An EIN is an Employer Identification Number, also known as a Federal Tax Identification Number, and can be used to verify a business entity.
