How Does Form 8849 Effect My 2290?

Alright, 2290 season is coming, and along with your Heavy Vehicle Use Tax (HVUT) comes a lot of questions and sometimes a little confusion. Sometimes while filing your Form 2290 you might see information about Form 8849, but what’s that? Do you need to be concerned with it? Today we’re here with the 8849 facts to answer your questions.

Form 8849

Form 8849 is the Claim or Refund of Excise Taxes Form. Excise taxes are the taxes paid on goods when they’re purchased and they’re often included in the price. An example of one of these goods is gasoline, hints your IFTA tax. Also, excise taxes include activities, such as highway usage by trucks.

Highway usage?! Now that might ring a bell because if you drive a qualifying vehicle of 55,000 pounds or more then you are required to file Form 2290 in order to get a copy of your stamped Schedule 1. 

After filing your Form 2290 you can File Form 8849 to claim a credit or a refund on the amount of  HVUT paid. Anyone can file this form if they need to claim a refund or a credit.

You can claim credits or refunds for vehicles that were stolen, sold, or destroyed. You can also claim credits for vehicles that were only used for 5,000 miles or less on public highways and 7,500 miles or less for agricultural vehicles used during the tax period.

Just remember, before you can File Form 8849 you need to file your Form 2290 and pay any Heavy Vehicle Taxes owed to the IRS for the current tax season first.

All you need to File Form 8849 is your name, EIN, and address, but it needs to match what the IRS has on file. You can verify your information by calling the IRS directly at 1-800-829-1040.  

If you’ve already filed your 2290 then you should already have your Employee Identification Number, as the IRS requires you to have one to complete your return.

If you haven’t filed your 2290 and you need an EIN you can apply for one online with the IRS. It will take about 15 days for the EIN to become active if the e-filing system and forms may be rejected during that time.

Also, you will need the information for the vehicle that you’re claiming a refund for with details as to why you’re claiming a credit or refund, such as if it was stolen, sold, or destroyed with the date that the incident occurred.

5 Common HVUT E-Filing Mistakes

Common HVUT Mistakes To Avoid

1. Entering Your VIN Incorrectly. Slow down, you need to make sure that all of your information gets entered correctly. Vehicle Identification Numbers consist of 17 characters that include both numbers and letters, so they can easily get mixed up.

Plus, VINs have incredibly small print. We often find ourselves squinting to reference our own! It might be hard to see if something is a 1 or an I, or a 0 or an O, so bust out your glasses to take a really good, close look at your VIN. After you enter it on your form double check it to makes sure that it’s correct.

2. Waiting too long to get your EIN. Sometimes people don’t realize that they need an EIN or Federal Tax Identification Number to file their 2290. Your EIN also serves as your Employment Identification Number.

You can apply for an EIN with the IRS directly, but keep in mind that it takes at least 15 days for your EIN to be added to the system. So, if you file your 2290 and apply for your EIN too close to the deadline, then your form could be rejected. If you need an EIN don’t wait til the last minute!

Some people ignore the fact that they need an EIN and put their SSN number in the field. The IRS no longer accepts Social Security Numbers in place of EINs! 

3. Mismatching mistakes. Keep in mind that your business name, address, and EIN has to match what the IRS has on file. You can call the IRS directly to verify your information.

4. Don’t enter the wrong tax year. It’s really easy to put the wrong year on checks, dates, important forms, and more! While you can e-file for 2290’s for previous years, if you want to file for the current tax year, which is July 2016 – June 2017, make sure you have those dates correctly selected.

5. Filing is put off until the last minute. No one wants to deal with taxes, so they wait as long as they can to file them, which usually results in filing too late or finding out that your form needs corrections that you don’t have enough time to make before the deadline.

So we’re gonna break things down real quick, and show you that you can e-file Form 2290 in 5 easy steps!

First Step – Login

The first step for any truck tax filer is to create their account—of course, if they’ve filed with us before, they can just sign in.

It’s easy, it only takes a moment, and it’s FREE. We won’t charge you a single cent for creating your account! You only pay once you’ve e-filed using our service, which won’t take too long, thankfully.

Second Step – Information

On your second step, you enter your business information. This includes your name and your Employer Information Number (EIN), which you need to make sure you know.

Third Step – Details

Now you need to enter your tax year and first used month for the vehicle(s) you are filing for. The tax year for IRS Form 2290 starts July 1 of each year and ends on June 30 of the following year.

You file Form 2290 based on the first used month of the vehicle. For example, if your vehicle was first used on public highways in September, you have until October 31 to file your 2290.

After that, enter your vehicle identification number (VIN) and the taxable gross weight of the vehicle you are filing for. You can also select if your vehicle is used for any special purposes, such as for agricultural use or logging.

Fourth Step – Payment

Just a quick update for our fleet managers out there! When you need to file HVUT for a fleet of vehicles, take advantage of our easy-to-use bulk upload feature.

Start by filling out First Used Month & Year, and then select Bulk Upload Using a File when you’re on the Taxable Vehicles tab.

The nice thing is, we provide an Excel template you can use to upload your data to our sites. Select Express Upload to continue.

Just follow these three steps! Download the template by following the “clicking here” link, fill out the saved file, and then upload the completed spreadsheet!

The excel template is easy to navigate, and has clear labels and drop down menus with itemized selections for your filing convenience.

If you make a filing error, our system will let you know! Click “View Upload Errors” to examine the errors. Once your errors are identified, simply fix the flawed entries in your downloaded spreadsheet and then re-upload the file by clicking “Bulk Upload using a File” again.

After that, you can view, file, and pay your HVUT taxes all at once! You have to admit, that’s way easier than doing each vehicle one-by-one.

HVUT Credits: Selling & Purchasing Vehicles

We’re a few weeks into 2016, and by this point you might have grown your fleet with a used (or new to you) truck. Or maybe you’re an Owner-Operator who is replacing an old vehicle. I mean, it looks like some sleeper trucks are just getting cheaper and cheaper. While you’re excited to be on the road in the new rig, it’s vital that you have your HVUT accounted for. How Do HVUT Credits Work?

When a vehicle is purchased from another owner who already paid their HVUT fees, the vehicle is covered until the end of the month of purchase. From the first day of the following month, it’s up to the new owner to pay the vehicle’s HVUT from the first day of that month to the end of the tax year.

With that said, it’s important to understand that the heavy vehicle use taxes DO NOT transfer from one owner to another. You’re required to file a Form 2290 and pay taxes on any qualifying taxable vehicle. The taxes also don’t transfer from your old vehicle to your new one! So if you sold your old truck after buying a new one, it’s the same process (just with the roles reversed). It’s annoying, sure, but you still have to do it.

Basically, the seller gets credited for the taxes they paid before they sold the vehicle, and the buyer owes the difference. And if you’re a seller, there are two ways to approach the credit. You can get the credit for the tax paid on your next Form 2290 filed or the refund can be claimed through Form 8849, if you don’t want to wait until the tax period ends.

What Are the Tax Implications When Buying or Selling a Suspended Vehicle?

Well, suspended vehicles come with a specific set of tax implications regarding their sale. If you sell a vehicle under suspension, you need to provide the following information:

  • Your name, address, and EIN,
  • VIN Number,
  • Date of the sale,
  • Odometer reading at the beginning of the period,
  • Odometer reading at the time of sale, and
  • Buyer’s name, address, and EIN.

If everything is reported like above and the use of the vehicle exceeds the mileage use limit for the period after the purchase (including highway mileage recorded by the former owner), the new owner would be liable for the tax on the vehicle. If the former owner didn’t provide the required statement to the new owner, then the former owner would be held liable for that tax period.

With your new rig ready for the road, you can get back out there to the long haul. Don’t forget, after you pay your HVUT for this tax period, you’ll still be liable to pay for the new period that starts July 1st, 2016!
