Form 2290 Suspended Vehicles

If a highway motor vehicle does not exceed mileage 5,000 miles or less (7,500 miles or less for agricultural vehicles) it is considered suspended and is exempt from tax. Mileage use limit means the use of a vehicle on public highways 5,000 miles or less (7,500 miles or less for agricultural vehicles). The mileage use limit applies to the total mileage a vehicle is used during a period, regardless of the number of owners.


An agricultural vehicle is any highway motor vehicle that is:

  1. Used (or expected to be used) primarily for farming purposes, and
  2. Registered (under state laws) as a highway motor vehicle used for farming purposes for the entire period. A special tag or license plate identifying the vehicle as used for farming is not required for it to be considered an agricultural vehicle.

So why would do you have to file if there is no tax due?  In order to obtain your registration and/or tags, state require and Stamped Schedule 1 from the IRS for all vehicles 55,000 lbs or more.  You must file Form 2290 in order to receive your Stamped Schedule 1.

Determining First Use Month

When E-Filing Form 2290 with ExpressTruckTax, you will be asked to provide the first use date for the vehicle. This dates refers to the time when the vehicle was placed in service during the tax period.  If the vehicle has been placed in service for  previous years and will continue to be in service this year, the first use month will be July.  This is because the tax period for Heavy Vehicle Use Taxes begins in July and ends in June.


If a new vehicle is placed in service during the tax period, the first use month will be the month in which the vehicle was first used. If a vehicle was only used for part of the tax period, the tax will be prorated based on the number of months the vehicle was actually used. For example, if a vehicle was used on January 27th, it will be taxed as though it was used the entire month, regardless of the fact it was only used for a couple of days, and the tax will be based on 6 months, instead of the full year.

What is an Agricultural Vehicle?

An agricultural vehicle is any highway motor vehicle that is:
  • Used (or expected to be used) primarily for farming purposes, and
  • Registered (under state laws) as a highway motor vehicle used for farming purpose for the entire period.
A vehicle is used primarily for farming purposes if more than half of the vehicle’s use (based on mileage) during the period is for farming purposes.


A special tag or license plate identifying the vehicle as used for farming is not required for it to be considered an agricultural vehicle.

Any agricultural vehicle traveling 7500 miles or less during the Heavy Vehicle Use Tax period, is considered a suspended or Category W vehicle and no tax is due.

Transferred Truck During 2290 Tax Year

A common question our Support Team at ExpressTruckTax is how to handle the situation when a vehicle is transferred to another company during the tax year. Assuming the Form 2290 was filed and the tax was paid for the current year, you would need to file a new Form 2290 under the new business name and EIN.  On the return, you will be able to claim the refund for the taxes that were paid under the previous business name and EIN.  You will need to call the IRS directly and they will walk you through the process or you can have a service provider, like ExpressTruckTax Plus to do it for you.


NOTE: The Form 2290 must be filed no later than the end of the month following when the transfer took place.  Example, if you formed a new business and the vehicles began operating under the new business name in February, your Form 2290 would have to be filed no later than March 31st.  If you file after March 31st, the return will be considered late and you may incur penalty fees.

Form 2290 RecordKeeping Requirements

There are specific recordkeeping requirements regarding Form 2290.  According to the Instructions for the IRS Form 2290:
You must keep records for all taxable highway vehicles registered in your name for at least 3 years after the date the tax is due or paid, whichever is later. They must be available at all times for inspection by the IRS. Also keep copies of all returns and schedules you have filed. Keep your records even if a vehicle is registered in your name for only a portion of a period. If the tax is suspended on a highway motor vehicle for a period because its use on public highways during the period did not exceed 5,000 miles (7,500 miles for agricultural vehicles), the registrant must keep the records at least 3 years after the end of the period to which the suspension applies.


Records for each vehicle should show all of the following information. 
    • A detailed description of the vehicle, including the VIN 
    • The weight of loads carried by the vehicle in the same form as required by any state in which the vehicle is registered or required to be registered 
    • The date you acquired the vehicle and the name and address of the person from whom you acquired it 
    • The first month of each period in which a taxable use occurred and any prior month in which the vehicle was used in the period while registered in your name, with proof that the prior use was not a taxable use 
    • The date the vehicle was sold or transferred and the name and address of the purchaser or transferee. If it was not sold, the records must show how and when you disposed of it 
    • If the tax is suspended for a vehicle, keep a record of actual highway mileage. For an agricultural vehicle, keep accurate records of the number of miles it is driven on a farm

    Form 2290 Credit Vehicles

    IRS Form 2290, Highway Heavy Vehicle Use Tax claiming credit for the following scenarios:
    • You can take credit for the vehicle if it was stolen, destroyed or sold before June 1 and not used during the remainder of the period, or
    • Used during the prior period 5,000 miles or less (7,500 miles or less for agricultural vehicles).


    A credit, lower tax, exemption, or refund is not allowed for an occasional light or decreased load or a discontinued or changed use of the vehicle.  What that means is if you filed your Form 2290 at 80,000 lbs, but had occasions where you operated at a lower weight class, that will not qualify you for a credit.  If you used your vehicle for only a portion of the tax year, you will qualify for the credit IF you did not exceed 5,000 miles (7,500 miles for agricultural vehicles).  If you did travel more than 5,000 miles (7,500 miles for agricultural vehicles) then you will NOT qualify for the credit.

    The credit for vehicles that were stolen, destroyed or sold during the tax year will be prorated based on the dates of the occurrence.  For vehicles sold, destroyed or stolen, you must include the VIN, taxable gross weight, and date of sale, accident or theft. The credit for the tax paid can be claimed on the next Form 2290 filed or the refund can be claimed on Form 8849.  You do not have to wait until the tax period ends.

    The credit for low mileage vehicles you either qualify for it and you will get the full amount that you paid as a credit or you will not qualify and you will not get any portion of the credit.  This credit is never prorated. For vehicles that tax was paid and the vehicles were used 5,000 miles or less (7,500 miles or less for agricultural vehicles), the credit (or refund) cannot be claimed until the end of the tax period for which the initial tax was paid.  Even if you know at some point during the tax year that you will not exceed the 5,000 mile mark, you will not be able to claim the credit until the tax period ends, which is on June 30th.

    The credit claimed cannot exceed the tax reported on Form 2290. If this occurs, any excess credit must be claimed using Form 8849, Claim for Refund of Excise Taxes, and Schedule 6, Other Claims.
